If you are being asked to make a statement (Section 98.1 under the Child and Family Services Act or Section 22 under the Ministry of Correctional Services Act) and you do not want to or are doing so only to avoid potential discipline,
- Do not sign or say anything to indicate that your statement is voluntary;and
- After the Ministry Investigator starts the recording device clearly say the following
If you work in the MCYS (Youth)
“Section 98.1 of the Child and Family Services Act requires that I cooperate with your investigation or I may face dismissal from employment. Understand that any statement I make in this investigation is not voluntary”
If you work in the MCSCS (Adult)
“Section 22 of the Ministry of Correctional Services Act requires that I cooperate with your investigation or I may face dismissal from employment. Understand that any statement I make in this investigation is not voluntary”
